Bergen County Prosecutor Gurbir S. Grewal announced today the arrest of [b]CESAR ROSARIO[/b] , DOB:: 10/30/1984, of 108 East 33rd Street, Paterson, New Jersey for the crimes of first degree Armed Robbery and second degree Conspiracy to Commit Armed Robbery. The charges are a result of the investigation by the Bergen County Prosecutor’s Office (BCPO) Major Crimes Unit under the direction of Deputy Chief Robert ANZILOTTI into the officer-involved-shooting which occurred on June 24, 2016, in the City of Paterson. This shooting resulted in the death of ISMAEL MIRANDA.
The investigation to date has determined the following: During the early morning hours of Friday, June 24, 2016, ROSARIO conspired to commit armed robbery with Ismael MIRANDA. The intended victims of the robbery were two individuals known to ROSARIO. The victims were operating a 2004 Honda Odyssey, which has been located, in the area of Summer and Cedar Streets, when they pulled over to meet with ROSARIO. ROSARIO and MIRANDA approached the vehicle, at which time MIRANDA drew a handgun and pointed it at the occupants demanding cash and narcotics. As the vehicle sped away, MIRANDA fired at the vehicle but missed. Two plain clothes Paterson police officers were on patrol in the area and were alerted by the sound of the speeding vehicle. The officers observed MIRANDA shooting at the vehicle and quickly approached him, ordering him to drop his weapon while identifying themselves as law enforcement officers. When MIRANDA did not comply, both officers fired their weapons, striking MIRANDA. He was subsequently pronounced dead at the scene. A .380 caliber handgun was recovered next to MIRANDA.
Cesar ROSARIO was arrested without incident at his residence by detectives from the BCPO Major Crimes Unit, on Tuesday evening, June 28, 2016. He has been charged with Armed Robbery and Conspiracy to commit Armed Robbery. His bail was set by the Honorable Cecilia Guzman, J.M.C., at $250,000.00 full surety, and he has been remanded to the Passaic County Jail.
Acting Bergen County Prosecutor Grewal states that these charges are merely accusations and that the defendant is presumed innocent until and unless proven guilty beyond a reasonable doubt.
