Eugene Miller, 33, of the Bronx, was found guilty by a State Supreme Court Jury of second-degree murder yesterday. He fatally shot his ex-girlfriend outside of their daughter’s day care facility.
Early morning on July 24, 2015, Rosetta Ewell, 30, was dropping off her 2 year-old daughter at a 139th W Street building in Harlem for day care. She was unaware that her stalker ex-boyfriend, the obsessive father of her two children was waiting for her, hidden behind the staircase. He shot her in broad daylight, two times in the face and one time in the head.
The shots were heard by the children and staff of the day care who called the police. Miller ran away and was eventually arrested that October. He was charged on January 20, 2016 and his trial has finally reached a verdict. Miller’s sentencing is scheduled soon for June 28, if convicted, he could face up to life imprisonment for his crime.
Miller had refused to accept Ewell had ended the relationship. He continued to harass her and monitor her whereabouts.
District Attorney Cyrus R. Vance Jr. warns, “When a gun is present in a domestic violence situation, the risk of homicide is increased by 500 percent. A 2016 analysis by Prosecutors Against Gun Violence concluded that federal law should be changed to prohibit the purchase and possessions of firearms by persons subject to temporary domestic violence restraining orders… I know this conviction cannot heal the wounds left by Rosie Ewell’s tragic death, but I hope it provides a sense of closure for her loved ones. ”
