Applicant Barred from Waterfront for Convictions for Assault of a Law Enforcement Officer as well as Other Crimes, Filing a False Unemployment’s Benefits Claim, and Fraud on His Application
The Commission rejected the application of Curtis McKelvey for inclusion in the Waterfront Commission Register as a warehouseman. The Commission found that McKelvey had been convicted of Assault of a Law Enforcement Officer, a felony, Trespass to Real Property, Assault and Harassment by Telephone, all misdemeanors.
The Commission also discovered that McKelvey had committed fraud twice: one by filing a claim for unemployment benefits at a time when he was, in fact, employed, two by failing to disclose his arrest for Trespass to Real Property on his Commission application.
The Chief Administrative Law Judge (ALJ) is to determine whether the Commission should deny McKelvey application. The ALJ concluded that McKelvey’s presence at the Port of New York district was a threat to the public peace or safety, and the application submitted by McKelvey’s has been denied.
